These Terms and Conditions ("Agreement") govern the professional relationship between Deluxe Properties Rwanda ("the Company," "we," "us") and our clients. By engaging our consultancy, brokerage, or management services, you agree to the following terms.
"Client": Any individual or entity engaging our services, including investors, buyers, sellers, or developers.
"Services": High-tier property marketing, investment consultancy, off-plan project facilitation, and legal documentation support.
Obligations: Buyers must provide accurate identification and financial readiness details to ensure efficient matching with luxury listings and off-plan opportunities.
Success Fees: Upon successful acquisition of a property, the Buyer agrees to pay a professional finder’s and processing fee of 1% of the final purchase price.
To maintain our standard of excellence, all listings undergo a verification process. Sellers must provide valid Title Deeds and disclose any known property encumbrances.
We offer two tiers of representation to suit your asset’s market strategy:
Standard Agency Mandate (3% – 5%): A flexible commission rate based on the project’s scale, location, and complexity. This covers standard listing placement and lead facilitation.
Exclusive Luxury Mandate (5%): This is our highest level of representation. This premium rate is non-negotiable as it triggers a dedicated marketing investment from the Company.
Unlike standard brokerage firms, an Exclusive Mandate with Deluxe Properties provides:
Capital Investment: We commit a specific budget for targeted digital advertising (Google & Social Media) and professional cinematography/drone tours.
Global Reach: Exclusive placement in our international investor newsletters and priority access to our VIP private database.
Price Protection: We act as the sole "Voice of the Property," preventing inconsistent pricing across different agents which often devalues luxury assets.
Accountability: Weekly performance reports and vetting of high-intent buyers to ensure your time is never wasted.
For off-plan projects, we act as the strategic marketing partner. While we conduct rigorous developer vetting, construction timelines and final delivery remain the contractual responsibility of the Developer as per the signed Sales and Purchase Agreement (SPA).
In strict adherence to Rwanda’s Law No. 058/2021 on the Protection of Personal Data and Privacy:
Data is used exclusively for transaction fulfillment and investment updates.
Client information is secured via encrypted protocols and is never shared without explicit consent.
Verified Channels: All payments must be made via regulated banking institutions in accordance with Rwandan law.
Exclusions: Professional fees do not include government taxes (IJP), notary fees, or RDB transfer charges.
Payment Timing: Agency fees are due only upon successful title transfer or as specified in the project-specific contract.
Deluxe Properties Rwanda provides expert market opinions and yield forecasts as professional estimates. We are not liable for market fluctuations or third-party developer delays.
Parties agree to seek an amicable settlement through mediation in Kigali. If unresolved, the matter shall be settled by the competent courts of the Republic of Rwanda.
Either party may terminate the engagement with 15 days' written notice, provided no binding offer or active transaction is in progress.
